The policy required construction or major renovations of single-family and multi-family residences over 500 square feet to earn LEED for Homes or Build It Green certification, new commercial developments less than 5,000 square feet to meet LEED certification standards, new construction projects greater than 5,000 square feet to achieve LEED Silver certification, and commercial renovations to earn at least 25% of the total LEED points available or the equivalent of LEED certification. All city-sponsored public facilities were required to achieve LEED Silver certification. The ordinance was repealed in 2011.

Residential projects that earn LEED Silver certification may qualify for expedited building plan review. Residential projects that earn LEED Gold certification qualify for guaranteed building inspections within two working days of a request for inspection. Residential projects that earn LEED Platinum shall receive a customized plaque recognizing the achievement.

In 2009, the Board of Supervisors of Alameda County adopted Ordinance 2009-16, establishing sustainable construction criteria for qualified projects in unincorporated areas of Alameda County. Covered projects include new or renovated residential projects 1,000 square feet or larger and commercial projects 3,000 square feet or larger. Qualified projects also must earn a specified number of LEED for Homes points or meet certain LEED minimum ratings. Expedited permitting is available for qualifying projects. This policy was repealed in 2010 by Ordinance 2010-65.

In 2009, the Morro Bay City Council approved Resolution 24-09, establishing a Green Building Incentive Program for residential and commercial new construction projects and major renovations. Single-family dwellings and multi-family dwellings under three stories are eligible for building and plan check fee rebates if they earn LEED for Homes certification. Multi-family dwellings four stories or greater and all new commercial construction projects must earn LEED certification to receive fee rebates. New construction of commercial interiors and tenant improvement projects must attain certification under the LEED for Commercial Interiors rating system in order to receive fee rebates. Commercial new construction and commercial interiors projects receive a greater fee rebate for each level of LEED certification attained. The program also includes incentives for greywater, renewable energy, and green roof systems.

In 2007, the Miami Lakes Town Council adopted Ordinance 07-92, establishing the Town of Miami Lakes Green Building Program. The program combines incentives and requirements for buildings with construction costs exceeding $50,000. Grants are available for residential building owners who prove minimum compliance with LEED, and homeowners who prove minimum compliance with LEED for Homes. Permitting fee reductions are available for commercial applicants that prove minimum compliance with LEED. The ordinance requires that all new municipal construction greater than 5,000 square feet and renovations valued greater than $200,000 achieve LEED certification. Projects receiving greater than 50% funding from the Town are also required to achieve LEED certification.

In 2007, the Mayor of Albuquerque enacted the 2007 Albuquerque Energy Conservation Code Volumes I and II, requiring commercial and multifamily residential buildings to be 30% more efficient than a baseline building per ASHRAE 90.1 1999 and requiring one- and two-family dwellings to meet ICC 2006 and several other energy efficiency requirements. The code does not apply to LEED-certified commercial and multi-family residential buildings that earn a minimum of 4 credits in EAc1 "Optimize Energy Performance," or one- and two-family dwellings that provide proof of LEED for Homes Silver certification.

In 2007, the Governor of New Mexico enacted SB 543. The omnibus bill included a sustainable building tax credit to promote the construction of high performance, green design and construction. The credit increases commensurate with the level of LEED certification achieved. The total amount of tax credits shall not exceed an aggregate amount of $5 million with respect to commercial buildings and an aggregate amount of $5 million with respect to residential buildings.

In 2011, the City of North Las Vegas enacted a policy requiring buildings to comply with LEED for Homes, or a city-approved alternative certification or standard. Buildings with a cool or green roof are additionally eligible for a floor-area bonus of 1.5 times the allowable gross floor area of the roof or an increase in height of one story over the maximum allowable height. If the roof is open to the public, the density/height bonus may be doubled. Moreover, projects that restore a natural area are granted double open space for the restored area.

In 2009, the City of Rhinebeck adopted a policy encouraging the use of LEED or an equivalent standard for commercial, office, and multi-family residential buildings larger than 4,000 square feet. The policy also stipulated that within one year of adoption, all municipal buildings were required to earn LEED certification, and within three years LEED Silver certifications. In 2008, the City of Dallas passed a Green Building Ordinance, requiring all new buildings to meet higher efficiency standards than current building energy codes. New residential buildings (one or two family homes) must meet minimum energy consumption required by the Dallas Energy Conservation Code. In Phase 2, all new buildings must comply with the Dallas Green Construction Code and be certifiable under the LEED for Homes standard. Commercial buildings that have less than 50,000 square feet of flooring must meet minimum energy consumption required by the Dallas Energy Conservation Code. Buildings larger than 50,000 square feet must submit a LEED scorecard demonstrating that they have incorporated a number of LEED credits.
