In 2009, the Charlotte County Board of Commissioners adopted Ordinance 2009-020. New residential construction and renovation projects certified to LEED for Homes and new commercial construction or renovation projects certified under the appropriate LEED, and land developments certified under the LEED for Neighborhood Development are eligible to participate in this program. All program participants are eligible for fast-track permitting and will be included in a marketing program to promote green building in Charlotte County.

In 2007, the Governor of Illinois enacted the Green Neighborhood Grant Act, becoming the first state to create incentives for LEED for Neighborhood Development. The law directs the Department of Commerce and Economic Opportunity to fund up to 1.5% of total development costs for up to three applicable neighborhoods per year, funds permitting. Applicable developments must be located in a municipality with a residential population of one million or greater, and are required to earn LEED for Neighborhood Development certification.

In 2009, the East Lansing City Council adopted a resolution requiring new municipal construction larger than 5,000 square feet to earn LEED Silver certification, and requiring renovations to follow a LEED checklist. The policy also requires private projects that receive municipal incentives up to 15% of the total project cost to earn LEED certification, private development projects that receive over 15% of the project costs in municipal incentives with one building to earn LEED Silver certification, and private development projects that receive over 15% in incentives with multiple buildings to achieve LEED for Neighborhood Development Silver certification and achieve at least 1 point under Green Infrastructure & Buildings Credit 1 or achieve at minimum LEED Silver certification for each building. Private building renovations that receive municipal incentives are required to earn LEED certification. Incentives include tax increment financing funds, brownfield redevelopment funds, community development block grant funds, parking revenue bonds, or other financing mechanisms. As of 2021, the Green Building Policy was under revision.

Bozeman's Municipal Code requires planned unit development proposals must comply with the city's design objectives and criteria. In order to be approved, a PUD proposal must earn at least 20 performance points from a combination of methods. Design proposals that include a commitment to design the majority of buildings to meet LEED certification requirements, or a city-approved alternative certification, will earn 6 points. Proposals that are conditionally approved to meet LEED for Neighborhood Development may quality for 15 points.

In 2010, the Borough of Park Ridge adopted Ordinance 2010-017, requiring all developments and redevelopments in the Neighborhood Business Zone to be compatible with the principles of LEED for Neighborhood Development. Projects are encouraged to incorporate a number of sustainability features into buildings and sites, including LEED certification.

In 2009, the Governor of Rhode Island enacted the Rhode Island Green Building Act. The Act requires all major facility projects of public agencies to achieve LEED certification, an or equivalent building certification. It also requires all major facility projects of public school districts where the project receives funding from the state entering the design phase after January 1, 2010, to achieve LEED Certified or the Northeast Collaborative for High-Performance Schools Protocol. The law was amended in 2017 to include LEED for Neighborhood Development (LEED-ND) and the Sustainable SITES Initiative (SITES) as applicable standards for the sustainable development of real public property beyond physical buildings. In 2022, the Green Buildings Act was amended again to include public buildings, public structures and public real property of cities and local governments.

In 2009, the City of Auburn enacted Ordinance 6245, creating a points system gauging a project's compliance with the City's mixed-use development provisions. Projects are required to meet a minimum of 100 points through a combination of design and construction practices. Residential projects earn 15 points for earning LEED for Homes or Neighborhood Development certifications, and 5 additional points for each subsequent level of certification achieved (Silver, Gold, or Platinum). Mixed-use development projects earn 15 points if the residential portion of the project LEED for Homes or Neighborhood Development certifications, with 5, 10 or 15 additional points for LEED Silver, Gold, or Platinum certifications, respectively. The non-residential portion of the project also earns 15 points for earning LEED certification, with 5 points for each additional level of certification achieved.
