In 2008, the Anchorage Assembly adopted Ordinance 2008-93, requiring all new municipal buildings - including private construction for municipal leasing or renting - and major renovation of municipal buildings to earn LEED certification. In 2012, the code was amended to increase the minimum required certification level to LEED Silver. The ordinance also required all Anchorage public schools exceeding 5,000 square feet to earn LEED certification. To incentivize certification, building permitting fees for public and private projects were refunded: 10% for projects that earned LEED certification, 15% for projects that earned LEED Silver, 22.5% for projects that earned LEED Gold, and 35% for projects that earned LEED Platinum. The ordinance was repealed in 2011 by Ordinance 2011-4(S-1).

In 2009, the City of North Miami adopted Ordinance 1278, creating a Sustainable Building Program. The Ordinance stipulated that all new construction or additions of city-owned buildings must achieve LEED Silver certification or higher, and that substantial renovations to existing city-owned buildings were required to achieve LEED certification, while minor renovations must incorporate as many LEED green building principles as feasible. For the residential sector, all Community Redevelopment Agency-owned or funded projects are required to attain LEED Silver certification. Existing CRA structures undergoing major renovations must achieve LEED certification. Minor CRA renovations are required to pursue as many LEED credits as possible. New construction, additions or substantial improvements of commercial developments are required to be LEED certifications, while minor commercial improvements are required to incorporate as many LEED strategies as is feasible. The ordinance also creates residential density bonuses for LEED-certified projects. An individual may be granted a density bonus up to 25 dwelling units per acre for green building certification coupled with transit-oriented development. Projects pursuing LEED certification may also receive expedited permitting, reduced permit fees, and project recognition by the city. This policy has been repealed.

In 2007, the Governor of Nevada enacted AB 621, amending provisions of tax abatements and exemptions based on energy use and repeals certain prospective energy requirements for public buildings. AB 621 creates a three-tiered property tax exemption plan, with a maximum exemption of 35% for any private building that earns LEED Silver certification or higher, excluding single-family homes and residential structures three stories or fewer. The legislation also removed sales tax exemptions for products or materials used in the construction of eligible buildings. In 2013, the State of Nevada adopted Assembly Bill 239, reviving the tax incentive for LEED-certified buildings and expanding its scope to investments in improving existing buildings. LEED-certified new construction may receive up to a 35% reduction on property tax payable for 5-10 years. Renovations to existing buildings that achieve LEED certification receive a 25-35% reduction, based on level of certification earned, property tax abatement for one year.

The policy also stipulated that within one year of adoption, all municipal buildings were required to earn LEED certification, and within three years LEED Silver certifications. All covered residential or non-residential projects are required to earn LEED certification within three years. The policy was repealed in 2016 by Local Law 1-2016.

In 2011, the Seattle City Council passed a resolution adopting a Sustainable Buildings and Sites Policy for municipal facilities, expanding the 2000 Sustainable Building Policy. The resolution requires all new construction, an addition or a major renovation of a City-occupied, City-owned building and impacting 5,000 or greater gross square feet to meet a minimum LEED Gold rating. In addition, all projects constituting a minor renovation or tenant improvement of a City-occupied, City-owned building, that both impacts 5,000 or greater gross square feet and involves substantial modification to all three of the major systems - mechanical, electrical, and plumbing - shall achieve a LEED Gold rating through the appropriate rating system. The resolution was repealed in 2018.
