In 2008, the Mayor of San Francisco enacted the San Francisco Green Building Ordinance, requiring proof of green building practices and LEED certification for all new residential and commercial construction. In 2011, the ordinance was updated by Administrative Bulletin 93 (updated again in 2012 and in 2020), requiring that projects meet the commercial and residential green building requirements of the California Green Building Standards Code (Title 24, Part 11). Smaller projects were originally only required to complete a green building checklist. Residential projects taller than 75 feet were originally required to earn LEED certification. In 2010, the requirement was amended to LEED Silver certification. Commercial projects larger than 25,000 square feet were originally required to earn LEED certification; in 2009, LEED Silver and in 2012, LEED Gold. In 2016, the Board of Supervisors of the City and the County of San Francisco adopted amendments to the city's Green Building Code. The updated code requires commercial buildings exceeding 25,000 square feet to earn LEED Gold certification and new residential projects to earn LEED Silver.

Pasadena Water and Power's Pasadena LEED Certification Program offers $15,000 grants for applicants who achieve LEED certification; $20,000 for LEED Silver; $25,000 for EED Gold; and $30,000 for LEED Platinum. In 2007, the Governor of Connecticut enacted HB 7432, requiring the Secretary of the Office of Policy and Management to adopt regulations for new or renovated commercial buildings consistent with LEED Silver, or an equivalent standard. The regulations apply to the following types of projects, provided that they receive $2 million or more in state funding: a) new state facility construction valued at $5 million or more approved and funded on or after January 1, 2008; b) state facility renovations of $2 million or more approved and funded on or after January 1, 2008; c) new public school construction valued at $5 million or more authorized on or after January 1, 2009; and d) public school renovations valued at $2 million or more authorized on or after January 1, 2009. The law also requires the State Building Inspector and the Codes and Standards Committee to revise the State Building Code to meet or exceed LEED Silver for all private buildings constructed after January 1, 2009 of $5 million or more and for all renovations beginning after January 1, 2010 of $2 million or more. residential buildings with less than four units are exempt from the code requirements, as well as buildings where costs may outweigh benefits. HB 7432 further authorized $30 million in state bonds, the sale proceeds of which are to be allocated to fund on-site renewable energy projects in state buildings pursuing LEED certification.

New Mexico Sustainable Building Tax Credit

In 2009, the Governor of New Mexico enacted SB 291, establishing the state's Sustainable Building Tax Credit. This legislation provides tax credits based on the square footage of the building. For commercial buildings, the tax credits range from $3.50 per square feet for buildings that achieve LEED for New Construction Silver certification to $6.25 per square feet for buildings that achieve LEED for New Construction Platinum certification. For residential buildings, the tax credits range from $5.00 per square feet for buildings that achieve LEED for Homes Silver certification to $9.00 per square feet for buildings that achieve LEED for Homes Platinum certification. On March 16, 2013, renewed the Sustainable Building Tax Credit, creating an additional $12 million opportunity for single-family residential green construction and $3 million in commercial and multifamily opportunities spread out over the next three years. LEED Silver-certified commercial buildings for new construction (NC), existing buildings, core and shell, or commercial interiors are eligible for a tax credit. The amount of the credit varies according to the square footage of the building and the level of certification achieved. On April 10, 2015, the Sustainable Building Tax Credit was renewed and updated again. The new SBTC guideline establishes a personal tax credit and a corporate tax credit for new and major renovations that are LEED Silver-certified or higher for taxable years up to 2026. The tax credit amount is based on certification level achieved and the amount of qualified square footage. The tax credit is available for commercial and residential buildings under LEED - NC, LEED EB and LEED CI and LEED for Homes. The 2015 update caps the eligible size per residential project at 2,000 square feet and reduces the amount of the tax credit available per square foot.

In 2014, Arlington County updated its Green Building Incentive program (which has been in place since 1999). The program provides density bonuses to large office, multi-family, and mixed use projects that earn LEED v4 Silver certifications. Projects may earn up to 0.25 FAR for LEED Silver, 0.35 FAR for LEED Gold, or 0.50 FAR for LEED Platinum. All participating projects must agree to submit 10 years of energy data to the County, and office projects must achieve an Energy Star score of 75 or better within 4 years of occupancy. Up to an additional 0.05 FAR may be earned if two of Arlington’s “Priority Credits” are achieved. Priority Credits are selected from the LEED scorecard and focus on energy efficiency, habitat restoration, light pollution reduction, and building reuse. Additional density may be requested for Net Zero Energy building certification. The program is enforced through a bond based on the size of the project. 75% percent of the bond is held until the LEED certification is achieved. Participants may also benefit from technical assistance and publicity.
