In 2001, San Mateo County adopted a Sustainable Building Policy, requiring all new buildings over 10,000 square feet to be built and certified to the highest practicable LEED rating. In 2017, the San Mateo Board of Supervisors approved an update to the Sustainable Building Policy, requiring county projects to earn at least 50% of LEED's Energy & Atmosphere credits and to achieve net-zero energy with generation from on-site or adjacent renewable energy resources.

In 2002, Cook County adopted an ordinance requiring that all new county building projects earn LEED certification and retrofitted buildings earn LEED for Existing Buildings. Projects are required to earn a minimum of 8 credits in the Energy & Atmosphere category. The ordinance also specifies that Cook County shall refer to the most current version of LEED when beginning a new building construction permit project or renovation.

Northbrook Green Building Initiative, Ordinance 08-24

In 2008, the Northbrook Village Board of Trustees adopted Ordinance 08-24, requiring all municipal construction to earn LEED certification. The policy also established the Northbrook Green Building Initiative Incentive Program, which provides rewards to projects that seek LEED certification. These projects receive expedited permitting and review and permit fee rebates. Fee rebates are as follows: 10% rebate for LEED Certified projects, 20% for LEED Silver, 30% for LEED Gold, and 40% for LEED Platinum. Projects that achieve certain Sustainable Sites or Water Efficiency credits may receive an additional 1% fee rebate for every credit achieved.

Oregon Administrative Rules, Chapter 330, Division 90

In 2012, the State of Oregon adopted Oregon Administrative Rules, Chapter 330, Division 90, establishing a Business Energy Tax Credit (BETC) for up to 35% of the eligible cost of qualifying renewable energy resource facilities. Eligible facilities include: an energy saving facility, recycling facility, rental dwelling weatherization facility, transportation facility, car sharing facility, sustainable building practices facility, alternative fuel vehicle or facilities necessary to operate alternative fuel vehicles, a high-efficiency combined heat and power facility, a high-performance home, a homebuilder-installed renewable energy system or a research development and demonstration facility that complies with the rules in place. A Sustainable Building Practices Facility means a a building that LEED-certified, or is rated and certified by a program approved by the Oregon Department of Energy. In addition to achieving LEED certification, a facility must also earn at least two points under LEED Energy and Atmosphere Credit 1 (Optimize Energy Performance) and at least one point under LEED Energy and Atmosphere Credit 3 (Enhanced Commissioning).

Engineering and Water Quality Sustainable Sites Program

In 2009, the City of Chattanooga established the Engineering and Water Quality Program, which allows commercial and residential projects that earn LEED certification with at least 5 points under the Sustainable Sites category (including SS 6.1 and 6.2) to receive a fee credit up to 60%.
