In 2009, the City of Morgan Hill adopted Ordinance 1966, requiring new single family or multi-family developments less than 2,000 square feet per unit must at minimum achieve 70 Build It Green (BIG) points or earn LEED certification. Projects exceeding 2,000 square feet per unit must earn LEED Silver certification or 70 BIG points. Commercial construction and renovations greater than 1,000 square feet must achieve 16 LEED points. Projects over 5,000 square feet are required to earn LEED Silver certification. Commercial renovations and tenant improvements valued at $350,000 or greater must achieve 10 LEED points. Projects greater than or equal to $500,000 permit valuation must earn LEED certification. Commercial projects valued greater than $1,500,000 must earn LEED Silver certification. For mixed use developments, the residential potion of the building must comply with minimum residential standards; whereas the commercial portion must satisfy certain LEED requirements, including recycling programs, low VOC and recycled materials, bicycle storage, and changing rooms with shower facilities.

In 2012, the Portland City Council adopted Ordinance 103-11/12, requiring all new construction and renovation projects owned or occupied by the City 2,000 square feet or greater to earn LEED Silver certification. All new construction and renovation projects 10,000 square feet or greater funded in whole or in part by the City shall demonstrate - under any third-party certification system or energy model signed by a licensed engineer - a certain percentage improvement in the proposed energy performance of the building compared to the baseline performance rating per ASHRAE Standard 90.1 or equivalent standard if the ASHRAE Standard 90.1 is not applicable to the project. The improvements are 30% for new construction, 25% for existing buildings, and 20% for historic buildings. LEED is an eligible certification system.

Municipal Buildings in the City of Saint Paul, Council Resolution 07-70

In 2007, the St. Paul City Council adopted Council Resolution 07-70, requiring that new or significantly renovated municipal facilities earn LEED Silver certification or a city-approved alternative standard. The resolution also states that if the building is constructed or renovated to LEED standards, the more stringent State Guidelines related to "Energy and Atmosphere," including exceeding the energy code by at least 30%, and the State Guidelines related to Performance Management must be met. The policy also requires that staff from various City departments become LEED accredited.

St. Louis Park Green Building Policy

In 2022, St. Louis Park enacted the St. Louis Park Green Building Policy, requiring new municipal, commercial, multi-family residential, and mixed-use projects 15,000 square feet or larger - and renovations in buildings 50,000 square feet or larger - that receive $200,000 or more in city financial assistance to certify to a third-party rating system, including LEED Silver or higher. Projects that must earn a minimum of 13 points within the Energy and Atmosphere: Optimize Energy Performance credit.

New York City Local Law 86

In 2005, New York City enacted Local Law 86, requiring all municipal construction, additions, or major renovations valued over $2 million to earn LEED Silver certification. Non-residential, capital projects costing over $2 million and funded at least 50% or $10 million by the city must earn LEED Silver certification. Municipal buildings that cost over $12 million shall be designed and constructed to reduce energy cost by a minimum of 20%, as determined by the methodology prescribed in LEED Energy & Atmosphere credit 1 or the New York State Energy Conservation Code, whichever is more stringent.

South Carolina Energy Efficiency Act, H 3034

In 2007, the Governor of South Carolina enacted H3034 establishing the South Carolina Energy Efficiency Act. The law requires all state-funded new construction projects larger than 10,000 square feet, including K-12 schools, or renovation project in which the project involved more than 50% of the replacement value major to earn LEED Silver certification. Agencies are required to use the most current edition of the rating system available at the time of registration and earn at least 40% of the available points under the Optimize Energy Performance credit.
